Welcome to Lume Loam. These Terms & Conditions govern your access to and use of the Lume Loam website, your communications with us, requests for quotations, sample requests, trade enquiries, custom product development and any commercial order placed with Lume Loam.

By accessing this website, submitting an enquiry, requesting a quotation, approving a sample or placing an order with us, you agree to these Terms & Conditions.

If you are acting on behalf of a company, hotel, retailer, distributor, design studio, procurement organisation or other business, you confirm that you have authority to accept these Terms on its behalf.

About Lume Loam

Lume Loam is an India-based brand offering handcrafted metalware, including tableware, serveware, drinkware and decorative objects for retail, hospitality, gifting, trade and commercial requirements.

Our collections may include products made from brass, copper, bronze/Kansa, tin, aluminium and other materials or material combinations depending on the individual product.

Use of This Website

A website listing does not automatically constitute a binding commercial offer.

For B2B orders, the applicable specifications are those stated in the final quotation, proforma invoice, purchase order acceptance, approved sample or other written order confirmation agreed between Lume Loam and the buyer.

Handcrafted Products & Natural Variation

Lume Loam products may be handcrafted, hand-hammered, cast, sculpted, formed, polished or hand-finished.

Because of this process, individual pieces may show reasonable variation in:

hammer marks;
surface texture;
colour;
patina;
polish;
dimensions;
weight;
edge character;
minor form;
finish sheen; and
other characteristics created by handcraft.

Such reasonable variation is part of handcrafted production and does not by itself constitute a defect.

Product photography should therefore be treated as representative rather than as a guarantee that every handmade piece will be mechanically identical.

Lume Loam’s existing terms similarly recognise small variations in handmade pieces as inherent characteristics of the making process.

Materials & Finishes

Products may be offered in materials including brass, copper, bronze/Kansa, tin, aluminium and other approved materials.

Natural metals can change with time.

Brass, copper and bronze may darken, oxidise or develop patina because of exposure to air, moisture, handling, climate and use.

Unless expressly stated otherwise in writing, natural ageing, oxidation and patination are not manufacturing defects.

Surface appearance may also vary between:

polished finishes;
hammered finishes;
brushed surfaces;
antique or aged finishes;
plated finishes;
lacquered finishes; and
naturally patinated products.

Buyers should request finish samples where precise finish matching is commercially important.

Food-Contact Products

Not every metal object offered by Lume Loam is intended for direct food or beverage contact.

Food-contact suitability must be confirmed for the individual product.

Decorative products must not be assumed to be food safe solely because they resemble bowls, trays, vessels or containers.

Where a product uses a lining, coating or specific construction for food use, this should be identified in the relevant product specification or commercial documentation.

Current Lume Loam terms distinguish between pieces intended for food use and decorative or unlined pieces.

For hospitality or commercial food-service orders, buyers should notify Lume Loam of the intended use before placing the order.

Product Dimensions, Capacity & Weight

Dimensions, capacities and weights published on the website are intended to assist product selection.

Because many products are handcrafted, reasonable tolerances may occur.

Where an exact dimension, capacity, fitting or tolerance is critical to a project, the buyer must inform Lume Loam before approving the product or placing the commercial order.

Project-specific tolerances should be agreed in writing where required.

Trade & B2B Enquiries

Submitting a trade enquiry does not automatically create a contract or guarantee supply.

We may request information including:

company name;
business type;
billing and delivery details;
country;
product references;
required quantities;
intended use;
material or finish preferences;
customization requirements;
target delivery date; and
supporting drawings or reference files.

Lume Loam may accept, decline or request further clarification regarding any trade enquiry.

Quotations

Unless stated otherwise, quotations are based on the information available when the quotation is issued.

A quotation may include:

product description;
material;
dimensions;
finish;
quantity;
unit price;
sample charges;
customization charges;
tooling or development charges;
packaging;
taxes;
shipping;
payment terms;
estimated production period;
quotation validity; and
applicable commercial conditions.

Quotations remain valid only for the period stated in the quotation.

If no validity period is stated:

Prices may need to be revised after expiry because of changes in raw-material cost, labour, exchange rates, freight, taxes or other commercial factors.

Minimum Order Quantities

Minimum order quantities may vary by:

SKU;

manufacturing technique;
customization;
packaging requirement; and
production complexity.

Lume Loam does not guarantee one universal MOQ across all products.

The applicable minimum quantity will be communicated during the quotation process.

Samples

Samples may be available for selected products or commercial requirements.

Unless otherwise agreed in writing:

samples may be chargeable;
shipping or courier costs may be payable by the buyer;
samples remain subject to handmade variation;
sample availability is not guaranteed for every product;
sample approval does not mean future production pieces will be mechanically identical; and
reasonable craft variation may remain in bulk production.

Sample Approval

Where a commercial order is based on an approved sample, the approved sample becomes an important reference for:

overall form;
material;
approximate dimensions;
finish direction;
surface character; and
workmanship.

The buyer must raise any required changes before approving the sample.

Changes requested after sample approval may:

increase cost;
require another sample;
change the production timeline; or
require a revised quotation.

Custom Product Development

Lume Loam may accept requests for modifications or custom products depending on feasibility.

Custom requirements may include changes to:

dimensions;
form;
capacity;
metal;
surface treatment;
finish;
engraving;
packaging; or
other agreed specifications.

Availability must be confirmed in writing.

Custom development may require:

development charges;
design charges;
tooling charges;
mould charges;
sampling charges; or
higher minimum quantities.

No custom request is accepted until its commercial and technical terms have been confirmed by Lume Loam.

Buyer-Supplied Designs & References

Where you provide drawings, artwork, logos, product designs, reference photographs, packaging files or other intellectual property, you confirm that you own those materials or have permission to use them.

You must not ask Lume Loam to reproduce material that knowingly infringes another party’s intellectual property rights.

You remain responsible for claims arising from materials or designs supplied by you.

Intellectual Property in Custom Development

Unless otherwise agreed in writing:

Lume Loam retains ownership of its pre-existing designs, techniques, know-how, processes and intellectual property;
supplying a product to a buyer does not transfer Lume Loam’s intellectual property rights;
custom development does not automatically transfer ownership of designs, moulds, tooling or development work; and
any exclusivity must be expressly agreed in writing.

Where ownership or exclusivity is important, it must be addressed in the applicable quotation, development agreement or commercial contract.

Order Confirmation

A commercial order becomes binding only when the agreed order-confirmation requirements have been completed.

Depending on the order, this may include:

written acceptance of the quotation;
confirmed specification;
sample approval where required;
accepted purchase order;
proforma invoice approval;
receipt of the required advance payment; and
confirmation by Lume Loam that the order has been accepted.

A website enquiry alone does not constitute an accepted order.

Pricing

Unless otherwise stated, B2B prices may be quoted according to:

order quantity;
product;
material;
finish;
level of customization;
packaging;
destination;
applicable taxes; and
agreed shipping terms.

Published consumer or retail pricing, where available elsewhere, does not automatically apply to trade or customized B2B orders.

Similarly, a trade quotation issued to one buyer does not guarantee the same pricing for another buyer, quantity or project.

Taxes, Duties & Import Charges

Prices will indicate whether applicable Indian taxes are included or excluded.

For international orders, customs duties, import taxes, brokerage charges, local taxes or destination-country fees may apply.

Responsibility for such charges will depend on the agreed shipping terms or Incoterm.

Where duties or taxes are not expressly included in the quotation, they remain the buyer’s responsibility.

Payment Terms

Payment terms will be stated in the applicable quotation, proforma invoice or order confirmation.

Typical orders may require an advance before production begins and payment of the balance before dispatch.

Payments must be made to the account or payment method officially provided by Lume Loam.

The buyer is responsible for checking payment instructions carefully. Lume Loam should be contacted directly if payment details appear to change unexpectedly.

Late or Failed Payments

Where payment is delayed:

production may be placed on hold;
dispatch may be delayed;
delivery estimates may change; and
Lume Loam may suspend additional work until the amount due is received.

Any late-payment interest or administrative charges will apply only where expressly stated in the applicable commercial agreement or invoice.

Production Timelines

Production timelines are estimates unless expressly guaranteed in writing.

Timelines may depend on:

product complexity;
order quantity;
raw-material availability;
sampling;
custom development;
buyer approvals;
finish requirements;
packaging requirements; and
production scheduling.

Lume Loam’s current consumer operation also treats its pieces as made to order and distinguishes production time from shipping time.

B2B buyers should rely on the timeline stated in their specific commercial confirmation.

Buyer Approvals & Delays

The buyer is responsible for providing required approvals, specifications, artwork, dimensions and other requested information promptly.

Delays caused by missing or late buyer information may extend:

sample development;
production;
packaging;
shipment; and
delivery timelines.

Lume Loam will not be responsible for delays resulting directly from information or approvals not provided by the buyer on time.

Changes After Order Confirmation

Changes requested after order confirmation are subject to approval.

A requested change may result in:

additional charges;
discarded materials or work;
new sampling;
revised MOQ;
revised delivery dates; or
inability to make the requested change.

No change is binding until approved in writing by Lume Loam.

Order Cancellation

Because products may be made to order, customized or produced specifically for commercial quantities, cancellation rights may be limited once production has begun.

Unless otherwise agreed:

orders may not be cancelled after production or custom development has started without Lume Loam’s written approval;
completed custom goods may be non-refundable;
committed raw materials, development costs, tooling and completed work may be chargeable; and
any cancellation refund will be determined after deducting applicable costs already incurred.

Any different cancellation terms stated in the specific quotation or contract will take priority.

Packaging

Products will be packed using packaging considered appropriate for their form and agreed mode of transport.

Packaging may vary depending on:

product size;
weight;
surface finish;
fragility;
order quantity;
domestic or international shipment; and
any agreed presentation requirement.

Custom retail, gift or branded packaging is available only where expressly confirmed.

Shipping & Delivery

Shipping arrangements depend on the commercial terms agreed with the buyer.

An order may be:

collected by the buyer or its nominated carrier;
shipped using a carrier arranged by Lume Loam; or
delivered under another agreed shipping arrangement.

Estimated arrival dates are not guaranteed unless expressly agreed.

Carrier delays, customs delays, port congestion, weather conditions and events outside Lume Loam’s reasonable control may affect delivery.

International Orders

International buyers must provide accurate:

company details;
delivery address;
contact details;
tax or registration information where required;
importing information; and
any documentation requirements known to the buyer.

The buyer is responsible for understanding import requirements applicable in its destination market unless Lume Loam has expressly agreed to provide specific compliance or customs services.

Risk & Title

Risk in the goods transfers according to the delivery or shipping terms agreed for the order.

Ownership/title may remain with Lume Loam until all amounts due for the applicable order have been paid in full, to the extent permitted by applicable law.

Where an Incoterm is included in the commercial documentation, that agreed Incoterm will determine the relevant delivery obligations and risk transfer.

Inspection on Delivery

Trade buyers should inspect orders promptly after delivery.

Check:

carton condition;
quantities;
visible product damage;
incorrect products;
material or finish discrepancies; and
any other apparent issue.

Do not discard packaging relating to a damaged shipment until the claim has been reviewed.

Damage, Shortage or Incorrect Goods

Any claim for transit damage, shortages or materially incorrect products should include, where relevant:

order or invoice number;
SKU/product reference;
affected quantity;
photographs of outer packaging;
photographs of inner packaging;
photographs or videos of affected products; and
a clear explanation of the issue.

Claims submitted after the agreed inspection period may be difficult to verify and may be rejected where permitted by law.

Defects vs Handmade Variation

A manufacturing defect is different from expected handmade variation.

The following will not normally be treated as defects when reasonable and consistent with the approved product:

individual hammer patterns;
small variations in surface texture;
minor colour differences;
natural patination;
slight variations in weight;
subtle dimensional differences; and
minor differences created by hand finishing.

Substantial departures from the agreed specification should be reported for review.

Returns for B2B Orders

Trade, customized and commercial orders are not automatically eligible for consumer-style returns.

Returns require prior written authorization from Lume Loam.

Goods returned without approval may not be accepted.

Approved returns must be:

unused unless the issue itself required inspection;
appropriately protected;
returned according to the instructions provided; and
accompanied by relevant order information.

Custom, personalised and made-to-requirement goods may be non-returnable unless defective or otherwise required by applicable law.

Remedies for Valid Claims

Where Lume Loam accepts a valid claim, the appropriate remedy may depend on the circumstances and may include:

repair;
re-polishing;
re-finishing;
re-tinning where applicable;
replacement;
remake;
credit; or
refund of the affected product value.

The remedy will be determined according to the nature of the issue, applicable agreement and law.

Lume Loam’s existing terms also contemplate repair, re-polishing and re-tinning for relevant products.

Product Care

The buyer should follow the care instructions supplied for the applicable product.

As a general principle, handcrafted metalware may require:

gentle hand washing;
mild cleaning products;
soft cloths or sponges;
prompt drying;
avoidance of abrasive cleaners; and
product-specific polishing or care.

Different metals and finishes may require different treatment.

Improper care, chemical exposure, abrasive cleaning or use contrary to the stated product purpose may void applicable remedies for resulting damage.

Product Suitability

The buyer is responsible for evaluating whether a product is appropriate for its intended commercial use unless Lume Loam has expressly confirmed suitability in writing.

This is particularly important for:

food contact;
acidic foods or drinks;
outdoor use;
high-volume hospitality use;
candles or heat exposure;
wet environments;
commercial cleaning processes; and
other specialist applications.

Inform Lume Loam of such requirements before ordering.

Resale Responsibility

Trade buyers reselling Lume Loam products are responsible for accurately communicating relevant:

product material;
care instructions;
food-contact limitations;
handmade variation;
dimensions; and
intended use

to their own customers.

Product information must not be altered in a manner that creates misleading safety, performance or material claims.

Website Intellectual Property

Unless otherwise stated, all content on this website is owned by or licensed to Lume Loam, including:

brand name;
logo;
product photographs;
product designs;
copy;
graphics;
illustrations;
videos;
catalogues;
page layouts; and
other creative material.

You may not reproduce, modify, republish, distribute, sell or commercially exploit this material without prior written permission.

Trade buyers may use officially supplied product assets only according to any licence or brand guidelines provided by Lume Loam.

Lume Loam Name & Brand

Purchasing Lume Loam products does not give a buyer ownership of the Lume Loam brand, trade name, logo or other intellectual property.

No buyer, distributor or reseller may present itself as:

Lume Loam;
an authorised exclusive representative;
an official distributor; or
an agent of Lume Loam

unless that status has been expressly granted in writing.

Confidential Information

During trade or custom-development discussions, either party may share confidential commercial information.

This can include:

pricing;
unreleased product designs;
drawings;
prototypes;
sourcing details;
quantities;
customer information;
business plans; and
other information reasonably understood to be confidential.

Each party should use confidential information only for the relevant commercial relationship and protect it from unauthorised disclosure.

Where required, a separate non-disclosure agreement may apply.

Third-Party Services & Links

The website may contain links to third-party platforms or services.

Lume Loam does not control third-party websites and is not responsible for their:

content;
availability;
policies;
security; or
services.

Your use of third-party websites is subject to their own terms and policies.

Website Availability

Buyer Indemnity

To the extent permitted by law, the buyer agrees to indemnify Lume Loam against third-party claims arising from:

buyer-supplied infringing designs or artwork;
false product claims made by the buyer;
unauthorised modification of products;
use contrary to stated product instructions;
unlawful resale activity; or
breach of these Terms.

Force Majeure

Lume Loam will not be responsible for delay or failure caused by events reasonably beyond its control, including:

natural disasters;
flood;
fire;
severe weather;
epidemic or pandemic;
war or civil disturbance;
government restrictions;
strikes;
transport disruption;
port congestion;
power or infrastructure failure;
raw-material shortages;
carrier disruption;
customs delays; or
other comparable events outside reasonable control.

If such an event materially affects an order, we will aim to communicate revised expectations as soon as reasonably practical.

Privacy & Personal Information

Personal and business information submitted through the website is handled according to the Lume Loam Privacy Policy and applicable law.

By submitting an enquiry, you authorize us to use the information reasonably required to:

respond to your enquiry;
assess your requirement;
prepare quotations;

If a separately signed agreement expressly conflicts with these website Terms, the separately signed agreement will govern that specific transaction to the extent of the conflict.

Changes to These Terms

Lume Loam may update these Terms & Conditions from time to time to reflect changes in:

products;
commercial processes;
policies; or
applicable law.

Changes will not retrospectively alter an already confirmed commercial contract unless agreed between the parties or required by law.
